Who Needs an NIL Agent?
A high school athlete with NIL earning potential currently evaluating schools, a high school athlete with an expectation to go Pro, college athletes in the transfer portal or with an expectation to go Pro (NIL agent relationship must end before they can be your Pro agent), athletes at each level seeking content creator opportunities and those looking to build a brand.
What Does an NIL Agent Do?
An NIL Agent’s role can be dual sided. An agent can assist in the transfer portal and help with brand building and brand deals.
What’s the Difference Between a Lawyer/Agent and a Typical Agent?
Agent Lawyer
- Licensed professional, must graduate law school and pass the Bar Exam to be able to practice
- Obligated to act in their clients best interest at all times or face fines, losing their license or jail time
- Drafts agreements from scratch, negotiates terms and analyzes legal risk
- Some lawyers can offer help outside of agency relationship (business transactions, wealth and tax planning, investment transactions, etc.)
Typical Agent
- Not licensed and 0 education requirements
- No experience drafting or reviewing contracts
- No repercussions for bad acts or bad service
Does an Athlete Need an LLC?
Not Necessarily. An LLC can provide legal protection, asset protection and in some instances tax benefits, but it’s not always necessary. If you don’t plan on creating content for brands often or have consistent costs related to your athletics it may not be necessary.

Before founding ATF Sports Agency, Jerome spent seven years practicing law at both Am Law 100 and respected mid-sized firms, advising sophisticated clients on complex business transactions and comprehensive wealth planning. He represented clients in transactions ranging from $5 million to $250 million and advised high-net-worth individuals and family offices with assets ranging from $5 million to several billion dollars.
